Jersey's Financial Services Commission takes action under Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008

The Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008 is "a law to make provision for the supervision of compliance by certain businesses with anti-money laundering and anti-terrorist financing requirements" and but that's a bit misleading. It does that but it also puts in place the need for registration and compliance with specified requirements. It's that, not the supervision, part that this action is taken under.

A company, REMAR Fund Ltd, is "is falsely claiming to trade from 17 and 18 Queen Street, St Helier. It is also carrying on, or holding out as carrying on, a Schedule 2 business (fund and security services activities) in or from within Jersey when it not registered with the JFSC."

There are none of the common qualifications such as "alleged to be." The Jersey Financial Services Commission is clear:

1 REMAR has never been registered, nor applied for registration, under the Supervisory Bodies Law. Therefore, any Schedule 2 business, as defined in Schedule 2 of the Proceeds of Crime (Jersey) Law 1999 carried out by REMAR, is in breach of Article 10 of the Supervisory Bodies Law.

2 From documentation held by the JFSC, REMAR, the websites and the email addresses display warning signs of being set up for fraudulent purposes.

The Commission asks that anyone who has had any dealings with Remar under any guise contact the enforcement team via https://www.jerseyfsc.org
