Laundering proceeds of old crime - Media Reports - Kerala

Monday, 31 March, 2025 - 09:57

We need more information and we need to get to the source, that being either the judgment or notes from the Enforcement Directorate to be able to confirm the report in The Hindu newspaper that the High Court in Kerala has said that prosecutions can be brought in respec of conduct that happened before the introduction of Prevention of Money-Laundering Act, 2002 where that conduct would be a predicate crime.

The report (https://www.thehindu.com/news/cities/Kochi/ed-may-file-money-laundering…) says that the Court said that where the proceeds of an old crime are laundered, then prosecution can arise.

Petitions filed by Shamsuddin, former Deputy Controller of Explosives, Ernakulam, and others challenging the ED case registered against them were dismissed.

Also, the Court found that it is not necessary to wait until trials of predicate offences are concluded before proceeding in respect of money laundering: this has been an issue in several jurisdictions around the world but has mostly been resolved in favour of saying that a laundering conviction is not dependent on a conviction for a predicate crime. .
